How To Have Justice When The System Is Broken

The system is designed to protect itself from justice.

A recent essay by Kenny Carmody titled - The Verdict Was Written Before the Trial describes the systemic failure of our judicial systems to uphold justice and ensure accountability. Carmody specifically addresses the failure of the vaccine injury compensation program to provide compensation to the majority of those harmed and killed by a vaccine.

He writes: “A genuinely just system produces accountability proportionate to harm.” By all accounts, the vaccine injury compensation program in Canada, the United States, and elsewhere, compensates but a fraction of the true number of individuals harmed. This, he argues, is by design. It gives the appearance of a functioning system of justice while ensuring that the full scope of vaccine harm is never fully recognized.

Carmody continues: “The question is not where to find justice in this system. The honest answer to that question is: you do not. The system is designed to protect itself from justice.”

Carmody then asks – What do you build when the existing system has demonstrated that it will not do what it is supposed to do?

Carmody offers the following solution:

1. Documentation that is distributed and irreversible. The narratives of the injured need to exist in forms that institutions cannot quietly disappear. Decentralized. Redundant. Timestamped. Outside the control of any single platform or body that can be pressured to remove them.

2. Communities that provide what the legal system will not. Not just emotional support, though that matters, but structured mutual aid, shared legal intelligence, collective memory. The injured finding each other not to commiserate but to constitute a record that the official record refuses to hold.

3. The patient cultivation of a different kind of accountability. Not through courts that were designed to prevent it, but through the historical record, through journalism that refuses to look away, through the accumulation of documented truth that eventually becomes impossible to contain.

I suggest that Carmody is describing the National Citizens Inquiry.

• The NCI is a system of documentation that is outside the control of any body that can be pressured to remove the evidence. In Carmody’s terms – decentralized, redundant and timestamped.

• The NCI is a community of structured mutual aid, shared intelligence, and collective memory. We hold a record that the official record - governments, courts and media - refuse to hold.

• The NCI is a different kind of accountability through the “accumulation of documented truth” that “eventually becomes impossible to contain”.

While the governments and media in Canada continue to ignore the almost 500 witness testimonies given over 42 days of hearings in 14 cities, the reality is that the government and media know we exist. They know the Commissioner’s Reports exist and have documented the evidence and the harm. Even more, the reports have offered solutions.

Eventually, the weight of this evidence and body of work will become visible to the masses. Like an air bubble in the water, it will eventually float to the surface, regardless of the efforts to prevent it. Someone described the current situation of governments pretending the NCI doesn’t exist this way – “They know we exist. We know that they know we exist. They know that we know that they know that we exist.”

There is something about truth, justice and accountability that cannot be held back indefinitely. In the words of Valery Legasov - “Every lie incurs a debt to the truth. Sooner or later that debt is paid.”

Carmody concludes: “None of this is the justice that was owed. But justice that arrives late, through the persistence of the people it was denied to, is still justice. And the refusal to forget, maintained long enough, is its own form of verdict.”
